These Terms and Conditions govern your access to and use of the Athlea platform, including our web application, mobile applications, API, and related products, software, websites, and services.

The Services are owned and operated by Athlea Ltd, a company registered in England and Wales with its registered office at 86-90 Paul Street, London, EC2A 4NE, United Kingdom.

Please read these Terms carefully. By accessing or using the Services, you accept and agree to them. If you do not agree, do not use the Services.

1. Definitions

TermMeaning
Business UserAny individual or entity accessing the Services for commercial, professional, or organisational purposes.
ConsumerAny individual accessing the Services primarily for personal, non-commercial use.
ContentAny data, text, files, information, or other material created, uploaded, or shared in connection with the Services.
DeveloperAny individual or entity that accesses the Services via the Athlea API.
AI FeaturesArtificial intelligence and machine learning capabilities made available as part of the Services.
SubscriptionA paid plan granting access to premium features of the Services.

2. Eligibility and Accounts

2.1 Age Requirement

The Services are intended only for individuals who are at least 18 years old, or the age of legal majority in their jurisdiction if higher.

2.2 Business Users

If you access the Services on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, “you” and “your” refer to that entity.

2.3 Account Registration

  • Provide accurate, current, and complete information and keep it up to date.
  • Create only one account per individual or organisation unless other terms allow otherwise.
  • Do not share your account credentials with others.
  • Notify us immediately of unauthorised access at security@athlea.ai.
  • Take full responsibility for all activity occurring under your account.

2.4 Third-Party Sign-In

You may register or log in using third-party credentials such as Google or Apple. By doing so, you authorise Athlea to pre-populate your account with information from those providers, subject to their privacy policies.

3. The Services

3.1 Scope

  • a web application accessible at www.athlea.ai;
  • mobile applications on iOS and Android;
  • a developer API and associated tooling; and
  • AI-powered features and tools.

Athlea may add, modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable. Access to certain features may vary by subscription tier or user type.

3.2 Service Availability

Athlea aims to provide a reliable and available Service but does not warrant uninterrupted or error-free access. Planned and unplanned maintenance may result in temporary downtime.

3.3 Personal Use

Unless you are a Business User with a relevant subscription or written agreement, the Services are for your personal, non-commercial use only. You may not resell, sublicence, or commercially exploit the Services without Athlea's prior written consent.

4. API and Developer Access

4.1 Developer Terms

Access to the Athlea API is subject to these Terms and any additional Developer Terms presented at the time of API key issuance. In the event of a conflict, the Developer Terms prevail with respect to API access.

4.2 Permitted Use

Developers may access the API only in accordance with Athlea's documentation and policies. You may not:

  • use the API to develop competing products or services;
  • circumvent rate limits, authentication, or other access controls;
  • use the API in a way that harms performance or stability; or
  • automate access outside the API in any manner not expressly authorised by Athlea.

4.3 API Keys

You are responsible for maintaining the confidentiality of your API keys. Athlea may revoke or suspend API access if we reasonably believe a key has been compromised or misused.

4.4 Rate Limits and Fair Use

API usage is subject to rate limits described in Athlea's documentation. Athlea may modify rate limits and throttle or suspend access that violates fair use principles or disrupts the Services for other users.

5. Subscriptions and Payment

5.1 Free and Paid Features

Certain features are available without charge. Access to premium features requires a paid Subscription. Athlea may modify which features are free or paid on reasonable notice.

5.2 Subscription Plans

When subscribing, you must select a plan such as monthly or annual. Please review your selection carefully before completing your purchase.

5.3 Pricing and Tax

Subscription fees are displayed at the point of purchase and are subject to applicable taxes. Fee changes take effect at the start of your next billing cycle.

5.4 Auto-Renewal

Subscriptions renew automatically unless cancelled at least 24 hours before renewal.

5.5 Cancellation

You may cancel your Subscription via account settings or by contacting billing@athlea.ai. Cancellation takes effect at the end of the current billing period.

5.6 Refunds

Except as required by applicable law, Athlea does not provide refunds or credits for partial subscription periods. Consumers may have additional rights under the Consumer Rights Act 2015, including a potential 14-day refund window for a first subscription where premium features have not been meaningfully used.

5.7 Free Trials

Free trials are available once per account. At the end of the trial period, the Subscription starts automatically unless you cancel at least 24 hours before it expires.

5.8 Payment Processing

Payments are processed by third-party payment providers. By providing payment information, you authorise Athlea and its processors to charge the applicable fees.

6. Intellectual Property

6.1 Ownership of the Services

The Services, including all underlying software, technology, designs, text, graphics, and other content created by Athlea, are owned by or licensed to Athlea and are protected by applicable intellectual property laws.

6.2 Licence to Use

Athlea grants you a limited, personal, revocable, non-transferable, non-sublicensable, non-exclusive licence to access and use the Services in accordance with these Terms.

  • You must not copy, modify, or create derivative works of the Services.
  • You must not reverse engineer or attempt to extract source code.
  • You must not sell, sublicence, or otherwise transfer access to the Services.
  • You must not use automated tools such as scrapers, bots, or crawlers except through authorised API use.

6.3 Your Content

You retain ownership of intellectual property rights in Content you submit. By submitting Content, you grant Athlea a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, process, adapt, and display your Content only as necessary to provide and improve the Services and as described in our Privacy Policy.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant Athlea a perpetual, irrevocable, worldwide, royalty-free licence to use that feedback without any obligation to you.

6.5 Trademarks

ATHLEA and associated logos and marks are trademarks of Athlea Ltd.

6.6 Infringement Claims

If you believe any content on the Services infringes your intellectual property rights, contact legal@athlea.ai with enough detail to identify the material and your ownership claim.

7. Acceptable Use

You agree not to use the Services:

  • in violation of any applicable law or regulation;
  • to upload, post, or transmit content that is unlawful, harmful, defamatory, harassing, abusive, obscene, or otherwise objectionable;
  • to impersonate any person or entity or misrepresent your affiliation;
  • to interfere with or disrupt the integrity or performance of the Services;
  • to attempt to gain unauthorised access to any part of the Services;
  • to engage in automated data collection outside authorised API use; or
  • to introduce malware, viruses, or other harmful code.

Athlea may investigate and take appropriate action, including suspension or termination of your account, where we reasonably believe you have violated this section.

8. Artificial Intelligence Features

8.1 Nature of AI Output

AI-generated outputs are probabilistic and may contain errors, inaccuracies, or incomplete information. You should independently verify the accuracy and suitability of any AI-generated output before relying on it.

8.2 No Professional Advice

Nothing generated by AI Features constitutes legal, financial, medical, or technical advice. AI outputs are provided for informational and productivity purposes only.

8.3 Your Responsibility

You are solely responsible for your use of AI Features and any decisions made in reliance on AI-generated outputs.

8.4 Data Use for AI

Athlea may use content submitted through the Services to train, improve, and evaluate AI models, subject to your privacy settings and as further described in our Privacy Policy.

8.5 Experimental Features

Certain AI features may be made available in beta or experimental form. These are provided without warranty and may be withdrawn at any time without notice.

9. Privacy and Data Protection

Athlea processes personal data in accordance with its Privacy Policy and applicable data protection legislation, including the UK GDPR and the Data Protection Act 2018.

You are responsible for ensuring that any personal data you submit about third parties is submitted lawfully. Business Users may also need a separate Data Processing Agreement.

10. Third-Party Services and Integrations

The Services may integrate with or link to third-party applications, services, or APIs. Athlea does not control and is not responsible for the content, availability, or practices of third-party services. Your use of third-party services is subject to their own terms and policies.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Athlea disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in this section affects any statutory rights you may have as a Consumer that cannot be excluded or limited by contract.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Athlea's total aggregate liability to you in connection with these Terms or the Services shall not exceed the greater of:

  • the total fees paid by you to Athlea in the 12 months before the event giving rise to the claim; or
  • GBP 100.

Athlea shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Nothing in these Terms limits Athlea's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law.

13. Indemnity

Business Users agree to indemnify, defend, and hold harmless Athlea and its officers, employees, agents, and licensors from and against claims, liabilities, damages, losses, and costs arising out of or in connection with their breach of these Terms, submitted content, unlawful conduct, or API use.

For Consumers, this indemnity applies only to the extent permitted by applicable law.

14. Term and Termination

14.1 Duration

These Terms apply from the date you first access the Services until your account ends.

14.2 Termination by You

You may delete your account via account settings or by contacting support@athlea.ai.

14.3 Termination by Athlea

Athlea may suspend or terminate your account immediately if we reasonably believe you have:

  • materially breached these Terms;
  • engaged in conduct that poses a risk to the Services, other users, or third parties;
  • failed to pay fees when due; or
  • ceased to be eligible to use the Services.

14.4 Effect of Termination

Upon termination, your licence to use the Services ceases immediately. Athlea may delete account data subject to retention obligations under applicable law and the Privacy Policy.

15. Dispute Resolution and Governing Law

15.1 Informal Resolution

We encourage you to contact admin@athlea.ai first so most disputes can be resolved informally.

15.2 UK Users

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

15.3 EU Users

If you are located in the European Union, these Terms are governed by the laws of Ireland, without prejudice to your rights under the laws of your EU Member State. You may also be able to use the EU Online Dispute Resolution platform.

15.4 Time Limit

Any claim arising out of or related to these Terms or the Services must be brought within one year of the date on which the claim arose, to the fullest extent permitted by applicable law.

15.5 Consumer Statutory Rights

Nothing in this section affects your statutory rights as a Consumer under applicable law, including your right to bring proceedings in the courts of your country of residence.

16. General

  • Entire agreement: these Terms, the Privacy Policy, Developer Terms, and incorporated documents form the entire agreement between you and Athlea regarding the Services.
  • Modifications: Athlea may update these Terms from time to time and will notify you of material changes at least 14 days before they take effect.
  • Severability: invalid provisions are modified only to the minimum extent necessary.
  • No waiver: failure to enforce a provision does not waive future enforcement.
  • Assignment: you may not assign these Terms without Athlea's written consent.
  • Force majeure: Athlea is not liable for failure or delay caused by circumstances beyond its reasonable control.
  • Language: these Terms are written in English and the English version prevails.
  • No partnership: these Terms do not create a partnership, joint venture, or agency relationship.
